Has the importance of timely IMR decisions been nullified? Workers' compensation system can take as long as six months or more to acquire an IMR decision from Maximus. A number of workers' compensation judges have determined that the Administrative Director's adoption of an untimely IMR (LC 4610.6(d) and AD Rule 9792.10.5(a)(1)) establishes a lawful ground for appealing the IMR determination pursuant to LC 4610.6(h)(1). In the majority's panel decision Arredondo v. Tri-Modal Distribution Services, Inc. the effect is to eradicate this argument, thus rendering timely IMR decisions more.
